TERMS AND CONDITIONS

TonerParts.com (the “Site”) is operated by Ace Laser Inc., doing business as TonerParts.com (“TonerParts,” “we,” “us,” or “our”), located at Unit 112 – 949 West 3rd Street, North Vancouver, British Columbia, V7P 3P7, Canada.

“Customer,” “you,” and “your” refer to any person or organization accessing the Site, creating an account, requesting a quotation, or purchasing products or services.

These Terms, together with our Privacy Policy, Cookie Notice, Shipping & Return Policy, Warranty Information, and any product-specific or quotation-specific terms, form the agreement between you and TonerParts.

You confirm that you have legal capacity to enter into this agreement. If you use the Site for a company or other organization, you confirm that you are authorized to bind that organization.

We may update these Terms when our services, policies, technology, or legal obligations change. The revised version will be posted on this page with a new effective date. Changes apply prospectively from the posted effective date, unless applicable law requires otherwise.

Terms applying to an accepted order will generally be those in effect when the order was submitted, subject to corrections, mandatory law, and any written terms specifically agreed for that order.

You may use the Site only for lawful shopping, product research, account management, order support, and other legitimate business or personal purposes.

You must not:

• Use the Site for fraud, unlawful activity, infringement, harassment, or deceptive conduct.
• Provide false account, billing, payment, tax-exemption, resale, or delivery information.
• Attempt to bypass security, access restricted systems, introduce malware, scrape the Site at an unreasonable rate, or interfere with Site operation.
• Use automated purchasing methods that disrupt availability or circumvent purchase limits.
• Copy, republish, or commercially exploit Site content except as expressly permitted.
• Impersonate another person or use an account or payment method without authorization.

We may restrict or suspend access where reasonably necessary to protect customers, TonerParts, service providers, or the integrity of the Site.

You are responsible for providing accurate information, keeping it current, protecting your password, and promptly notifying us of suspected unauthorized access. Activity completed through your account may be treated as authorized unless you notify us promptly.

Approved business-account credit terms, including any Net 30 arrangement, require separate written approval and may be changed or withdrawn based on account status, credit review, late payment, or misuse. A purchase order does not override these Terms unless TonerParts expressly accepts different terms in writing.

We may close inactive, duplicate, fraudulent, or abusive accounts, subject to applicable law.

We make reasonable efforts to keep product titles, specifications, page yields, compatibility lists, images, availability, and descriptions accurate. Manufacturers may change packaging, components, specifications, firmware, country of origin, or model details without notice. Product images may be illustrative, and actual packaging may differ.

Page-yield figures are estimates based on the applicable industry or manufacturer test standard and specified page coverage. Actual yield varies with content, coverage, print settings, environmental conditions, printer condition, and usage patterns.

You are responsible for confirming the correct part number and printer model before ordering. Please contact us before purchase if compatibility is uncertain. A typographical or catalog error does not require us to supply an incorrectly described item where the law permits correction or cancellation.

• OEM products are produced or branded by the original equipment manufacturer and are covered by the manufacturer’s applicable warranty.
• Compatible products are non-OEM products designed to work with specified printers.
• Remanufactured products use a previously manufactured cartridge core that has been cleaned, inspected, rebuilt, refilled, and tested as applicable.

References to printer manufacturers, brands, and model numbers identify compatibility and do not imply sponsorship, endorsement, or manufacture by those brands unless the product is expressly identified as OEM.

Customers should review printer and firmware requirements. We do not recommend installing firmware updates solely for the purpose of disabling third-party supplies. Compatibility support remains subject to the product description, warranty terms, and applicable law.

Prices and promotions may change without notice before an order is accepted. Prices are shown in the currency displayed on the Site—generally CAD or USD—and exclude applicable taxes and shipping unless stated otherwise.

Applicable sales taxes are calculated based on the order, delivery location, and legal requirements. Customers claiming tax exemption or resale status must provide valid documentation acceptable to TonerParts.

Coupons, volume discounts, account pricing, rebates, free-shipping offers, and promotions may have separate eligibility rules, dates, exclusions, purchase limits, or non-combination restrictions. Unless stated otherwise, promotions have no cash value and cannot be applied retroactively.

Despite reasonable care, a price, discount, specification, inventory quantity, shipping charge, tax calculation, or other listing may occasionally be incorrect. Where legally permitted, we may correct the error before accepting or fulfilling the affected order.

If the correct price is higher than displayed, we may cancel the affected item or order, notify you, and offer the opportunity to purchase at the correct price. If payment was captured for a cancelled item, we will issue the applicable refund. We will not substitute a materially different product without your consent.

Your order is an offer to purchase. An automated order confirmation only confirms receipt and does not necessarily mean the order has been accepted. We accept an order when we confirm shipment, provide the product for pickup, or otherwise expressly accept it.

We may reject or cancel an order before acceptance for reasons including inventory shortage, supplier discontinuation, pricing or catalog error, payment failure, suspected fraud, export or legal restriction, unreasonable quantity, delivery limitation, or inability to verify information. We will notify you and refund any captured payment for cancelled items.

Orders may be shipped in separate packages or from different Canadian or U.S. warehouses. Backorders and special orders are subject to availability and any terms disclosed at purchase.

You authorize TonerParts and its payment providers to charge the total disclosed at checkout, including product price, shipping, taxes, and approved adjustments. You confirm that you are authorized to use the selected payment method and that the billing information is accurate.

We may use address verification, identity checks, payment authorization, manual review, or requests for supporting information to prevent fraud. We may delay, decline, or cancel an order that cannot be reasonably verified. Payment-card information is processed by payment service providers according to their terms and our Privacy Policy.

Chargebacks should not be used to avoid the return, warranty, or customer-service process. This does not restrict legitimate chargeback rights available under applicable law or card-network rules.

We currently ship to Canada and the United States only. Processing times, regional rates, carrier options, remote-area charges, P.O. Box rules, tracking, address corrections, damaged shipments, and lost-package investigations are described in our Shipping & Return Policy.

Delivery dates are estimates, not guarantees, unless we expressly agree otherwise in writing. Delays may occur because of carriers, weather, customs, labour disruption, supply shortages, address problems, or events outside our reasonable control.

Title and risk of loss pass as required by applicable law. Where legally permitted, risk passes upon delivery to the address provided. If you authorize unattended delivery, a safe-drop location, freight forwarding, or delivery to a third party, you accept the additional risks associated with that instruction.

U.S. customers are responsible for any import duties, brokerage, customs charges, or local taxes not collected at checkout, unless the order expressly states that such charges are included.

Contact us immediately if you need to change or cancel an order. We cannot guarantee a change after processing begins. Under our current policy, cancellations or modifications requested after 1:00 PM Pacific Time may be subject to a 20% administration and restocking fee. If an order has shipped, shipping charges and the applicable return terms also apply.

Special-order, custom-configured, opened OEM, clearance, and final-sale items may not be cancellable or returnable except where required by law or where the item is defective under an applicable warranty.

Returns require a valid Return Merchandise Authorization (RMA) and are governed by our Shipping & Return Policy. For return questions or assistance with an RMA request, contact support@tonerparts.com.

The current general framework includes:

• Refund or exchange requests within 30 days of delivery.
• Store credit or exchange requests up to 90 days from delivery.
• Unused, complete, resalable non-defective merchandise; customer-paid return shipping; and a 20% restocking fee.
• Inspection of defective returns before refund, credit, or replacement.
• Additional restrictions for OEM products, imaging drums, special orders, installed products, and incomplete or damaged returns.

If these Terms conflict with the more specific Shipping & Return Policy, the specific policy applies to the return, except that mandatory law always prevails.

Warranty coverage is described in our Warranty Information. The current framework includes a 100% satisfaction guarantee for compatible and remanufactured ink and toner, eligible compatible-product defect replacement within one year from the shipping date, and a six-month limited warranty for compatible imaging drums.

OEM warranty claims are generally handled directly by the original manufacturer. Warranty coverage does not include misuse, improper storage, unauthorized alteration, installation damage, printer defects, normal wear, physical damage, or use beyond stated eligibility limits.

Except for express written warranties and rights that cannot legally be excluded, no additional warranty is created by product advice, website content, or customer support.

Printer repair, installation, maintenance, consultation, quotations, and special-order purchases may have separate written terms covering diagnostics, labour, parts, travel, deposits, estimates, service limitations, and payment. Those specific written terms control for that service or order if they conflict with these general Terms.

Estimates are based on information available at the time and may change if additional faults, parts, labour, or access requirements are discovered. We will seek approval before materially exceeding an approved estimate where required by law or our written service terms.

The Site and its original text, graphics, logos, product photography, layout, code, databases, and compilations are owned by or licensed to TonerParts and protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Site for lawful personal or internal business purchasing. You may print reasonable copies for order records or product evaluation. You may not reproduce, sell, republish, systematically extract, modify, frame, reverse engineer, or create derivative commercial works from Site content without written permission.

Third-party product names and trademarks belong to their respective owners and are used for identification and compatibility purposes.

If you submit a review, question, photo, suggestion, or other content, you confirm that it is truthful, relevant, lawful, and that you have the right to submit it. Do not submit confidential information, personal information about others, infringing material, malware, threats, spam, or deceptive endorsements.

You retain ownership of your content but grant TonerParts a worldwide, non-exclusive, royalty-free licence to host, reproduce, format, display, and use it for Site operation, customer support, and lawful marketing, subject to applicable privacy law. We may moderate or remove content that violates these Terms, but we do not prohibit honest consumer reviews or criticism.

The Site may use or link to Shopify, payment processors, shipping carriers, product manufacturers, review providers, tracking services, social networks, and other third parties. Their sites, systems, products, and policies are controlled by them, not TonerParts.

A link or integration does not necessarily mean endorsement. To the maximum extent permitted by law, TonerParts is not responsible for independent third-party content, availability, security, or transactions. Please review the third party’s terms and privacy policy before using its service.

Our collection, use, disclosure, storage, and protection of personal information are governed by our Privacy Policy and Cookie Notice, as updated from time to time, and applicable privacy law.

By providing contact information, you agree that we may send transactional communications necessary for quotations, account verification, payment, orders, delivery, returns, warranty, security, or support. Marketing messages are sent only as permitted by applicable law. You may unsubscribe from marketing through the message link, but may still receive necessary transactional communications.

Electronic records, notices, and confirmations satisfy written-communication requirements to the extent permitted by law.

We work to maintain a secure and reliable Site, but uninterrupted or error-free availability cannot be guaranteed. The Site may be unavailable for maintenance, updates, technical faults, cyber incidents, or events outside our control.

You are responsible for using current software, protecting your device and credentials, maintaining backups of information important to you, and verifying downloads or communications. Please report suspected security issues to us promptly.

To the maximum extent permitted by applicable law, the Site and general informational content are provided on an “as available” basis. We do not guarantee that every description, compatibility reference, inventory quantity, or website function will always be complete, current, or error-free.

To the maximum extent permitted by law, TonerParts is not liable for indirect, incidental, special, exemplary, punitive, or consequential loss, including loss of profit, revenue, data, opportunity, or business interruption, arising from Site use or a product or service.

Where liability cannot be excluded, TonerParts’ aggregate liability relating to a product or order will not exceed the amount paid for the affected product or service, except where a greater remedy is required by law.

To the extent permitted by law, if you use the Site for business purposes, you agree to indemnify TonerParts against third-party claims, losses, and reasonable costs caused by your unlawful use of the Site, infringement of another party’s rights, fraudulent conduct, or material breach of these Terms.

This section does not require an individual consumer to indemnify TonerParts for TonerParts’ own negligence, breach of contract, unlawful conduct, or any matter that cannot legally be shifted to the consumer.

We are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, fire, flood, epidemic, war, civil disturbance, government action, border or customs delay, labour disruption, transportation interruption, cyberattack, utility failure, supplier shortage, or carrier failure.

We will make reasonable efforts to communicate material delays and resume performance. This section does not remove cancellation, refund, or other rights that applicable law grants to the customer.

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules.

Before starting formal proceedings, please contact us so we can try to resolve the concern. Subject to mandatory consumer law and any court with non-waivable jurisdiction, disputes may be brought before the courts located in British Columbia.

Nothing in these Terms prevents a consumer from using a regulator, consumer-protection process, small-claims process, or court available under applicable law. These Terms do not require arbitration, waive class-proceeding rights where such a waiver is prohibited, or restrict legally protected consumer reviews.

• Entire agreement: These Terms and incorporated policies form the agreement for Site use and online purchases, together with any accepted order- or service-specific written terms.
• Severability: If a provision is invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions continue.
• No waiver: A delay in enforcing a right does not waive it.
• Assignment: You may not assign your rights or obligations without our written consent. We may assign these Terms as part of a merger, reorganization, financing, or sale of business, subject to applicable law.
• Headings: Headings are for convenience and do not change meaning.
• Language: The parties request that these Terms and related documents be written in English, subject to any mandatory language rights.
